By accessing, registering on, or purchasing any product or service from sxm.tools ("the Site"), operated by SXMWARE, you agree to be legally bound by these Terms of Service ("Terms") in their entirety. If you do not agree to every provision contained herein, you must immediately cease using the Site and all associated software.
Your continued use of any SXMWARE product or service — including downloading software, activating a license, or maintaining an account — constitutes ongoing acceptance of these Terms as they may be updated from time to time.
You must be at least 13 years of age to create an account or use SXMWARE services. If you are under the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. SXMWARE reserves the right to request age verification at any time and to terminate accounts that do not comply.
SXMWARE offers software tools distributed in two models:
Important: You are purchasing a license to use the software — not ownership of the software itself. SXMWARE retains all intellectual property rights to every product, in perpetuity.
Software updates, feature additions, or changes to a product during the license period are at SXMWARE's sole discretion. A one-time purchase does not guarantee perpetual access to future versions or features released after purchase.
Subject to these Terms and timely payment, SXMWARE grants you a limited, non-exclusive, non-sublicensable, non-transferable, revocable license to:

SXMWARE employs a Hardware Identification (HWID) verification system to authenticate and validate software licenses. This system works as follows:
HWID Reset Policy: If you upgrade or replace hardware, a limited number of HWID resets may be available through your account dashboard. Each reset request is logged and reviewed. Excessive or abusive reset patterns may result in license suspension without refund. SXMWARE reserves the right to set, modify, or remove the number of resets permitted per license at any time.
SXMWARE is not responsible for license deactivation caused by significant hardware changes, operating system reinstallations, or virtualization software that alters the hardware fingerprint. Users are advised to perform HWID resets before making major hardware changes.
SXMPLUS is a recurring subscription service billed on a monthly or annual basis via Ko-fi. The following terms apply:

Violation of these prohibitions may result in immediate account termination, license revocation, and potential legal action, without any entitlement to a refund.
All content on the Site and within SXMWARE software — including source code, compiled binaries, designs, graphics, logos, user interface elements, documentation, and marketing materials — is the exclusive intellectual property of SXMWARE and is protected by copyright, trademark, and other applicable intellectual property laws.
SXMWARE reserves all rights not expressly granted. Nothing in these Terms shall be construed as transferring any intellectual property rights to you.
SXMWARE software and services are provided "AS IS" and "AS AVAILABLE" without any warranty of any kind, express or implied, including but not limited to: warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted and error-free operation.
SXMWARE does not warrant that the software will be free of bugs, that defects will be corrected, or that the software or the servers that make it available will be free of viruses or other harmful components. You use SXMWARE software entirely at your own risk.
To the maximum extent permitted by applicable law, SXMWARE and its operators, affiliates, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, loss of business, or any other commercial damages or losses — arising from your use of, or inability to use, SXMWARE products or services, regardless of whether SXMWARE was advised of the possibility of such damages.
In no event shall SXMWARE's total aggregate liability to you exceed the amount you paid to SXMWARE in the three (3) months preceding the event giving rise to the claim.
SXMWARE reserves the right to modify, update, amend, or replace these Terms at any time, at its sole discretion, without prior notice. Changes are effective immediately upon publication on the Site. It is your responsibility to review these Terms periodically. Continued use of the Site or software following any update constitutes your acceptance of the revised Terms.
SXMWARE also reserves the right, at any time and without notice, to:
SXMWARE may terminate or suspend your account and revoke all licenses at any time, with or without cause, with or without notice, effective immediately. Grounds for termination include (but are not limited to): violation of these Terms, fraudulent activity, abuse of the HWID reset system, chargebacks, or any conduct SXMWARE deems harmful to the platform or other users.
Upon termination, your right to use SXMWARE software ceases immediately. No refund will be issued as a result of termination for cause.
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of SXMWARE shall be resolved through good-faith negotiation first. If unresolved, disputes shall be subject to binding arbitration or the exclusive jurisdiction of competent courts, as applicable in your jurisdiction.
